1. Effective Date: The revised terms and conditions will be effective from June of 2022.
2. Purpose: Forum.Jungtosociety.org website, operated by the Jungto International, aims to be a communication forum for people from all over the world who relate to the message of Ven. Pomnyun Sunim, share their opinions, and interact through voluntary participation and activities.
3. Member Classification
- Non-member: A person who uses the services provided by the Forum.Jungtosociety.org website without signing up for a membership on the website.
- Member: A person who uses the services provided by the Forum.Jungtosociety.org website after signing up for a membership on the website.
- In these terms and conditions, the term “members” refer to those who have signed up for a membership on the Forum.Jungtosociety.org website.
4. Effect and Change of Terms and Conditions
- The terms and conditions become effective when the prospective member clicks the “agree” button when prompted to “agree to the terms and conditions”.
- If a reasonable reason arises, the Jungto International may change the terms and conditions. Any changes to the terms and conditions will be immediately announced on the website (Forum.Jungtosociety.org).
5. Use of Personal Information
- Jungto International may retain personal information submitted by those who sign up for a membership.
- Jungto International will not disclose or distribute any member’s personal information to a third party without their consent.
- Jungto International may use all or part of the members’ information as statistical data related to operations.
- After one year of not logging into the website, a member’s account status will be changed to dormant and the associated personal information will be stored separately. After another 1 year of not logging in, the member’s account and the associated personal information will be deleted.
6. Termination of Contract (Membership)
When a member wants to terminate their membership, they can apply for withdrawal using the “member withdrawal” menu of the personal information modification. If a member applies for withdrawal, the withdrawal process will be completed immediately.
7. Use of Personal Information of Withdrawing Members
- Jungto International will completely delete any personal information such as ID and name of the withdrawing member from the data at the time of member withdrawal so that the information cannot be reproduced or restored.
8. Disqualification: Jungto International may terminate a user’s membership or suspend the use of its service without prior notice for any of the following reasons:
- Omitting member information
- Signing up for a membership with false information
- Using stolen ID and password
- Infringing the intellectual property rights of other members or third parties of the Jungto Forum website
- Harming the well-being, order, and morals of society
- Defaming or causing a disadvantage to others.
- Causing an interruption to the information and communications network
- Conducting commercial activities such as sales promotion using the services of the Jungto Forum website without the permission of the service provider.
9. Services Provided to the Members
- Access to the schedules and the Zoom link related to customized events such as Sunday Meditation, Live Dharma Talk, and 1000-Day Practice.
- Access to the website link that allows members to register questions at any time for Sunday Meditation and Live Dharma Talk.
- Email reminders before an event.
10. Information Provision
- Jungto International may deliver information deemed useful to the member by email, and if the member does not want it, they can refuse to receive it by specifying it in the personal information management menu.
- For notices that members must be aware of, such as changes to the membership agreement, privacy policy, and other important business policies, a notification e-mail can be sent to members regardless of their refusal to receive emails.
11. Members’ Posts
- Posts refer to all posts, questions, answers, and materials posted by members on various bulletin boards of the Jungto Forum website.
- Jungto International has the right to post on the website.
- Any loss or problems caused by posts and information posted by members is the responsibility of the individual member, and the Jungto International is not responsible for it.
- If a third party’s claim, litigation, or any other dispute arises due to a member’s posting, the member is responsible and must cover the cost of resolution and handle the dispute for the Jungto International. In the event that Jungto International has to compensate the third party or suffers a loss, the member must reimburse all costs incurred to the Jungto International.
- Jungto International will delete a member’s post without prior notice for any of the following reasons:
(a) Defaming a third party by slandering.
(b) Posting content that poses a direct and obvious physical threat to others; that encourages or recommends self-harm or suicide of others; that reveals other people’s personal information; that poses constant harassment or bullying to others; that offers, mediates, induces or coerces prostitution; or that poses a direct and serious threat to public safety.
(c) Posting content that violates various rights such as infringement of copyright of the Jungto Forum, infringement of copyright of a third party, and defamation.
(d) Posting content that may cause sexual shame or distorted sexual views, such as depicting provocative and explicit sexual acts; that is violent and provocative in nature and may cause cruelty or disgust to others; that deceives others by impersonating or claiming false information; that causes disgust or displeasure through repeated use of excessively abusive or vulgar language.
(e) Exceeding the posting period stipulated by the Jungto International.
(f) Posting commercial posts or commercial advertisements.
(g) Posting content that is not compatible with the purpose of the website.
(h) Posting content that is considered to be in violation of other related laws.
- The members themselves are solely responsible for all damages caused by any violation of paragraph e and the cost of any legal action by related organizations.
- Jungto International does not have an obligation to store posts deleted due to the reasons specified in paragraph e.
- Jungto International does not have any obligation to monitor or censor any of the members’ posts.
12. Use of Member Posts
- The copyright of the post published by a member on the website belongs to the member who published it. Also, postings cannot be used without the consent of the publisher for neither commercial nor non-commercial purposes. For non-commercial purposes, it can be used with the consent of the publisher.
- Members and the Jungto International cannot commercially use the materials posted on the website, including arbitrarily processing or selling information obtained through the service.
- Jungto International does not take any responsibility for the accuracy and reliability of information posted or transmitted by email through this service, and members are solely responsible for civil and criminal responsibilities arising from their respective postings. Jungto International does not take any responsibility for the accuracy and reliability of information posted, emailed, or otherwise transmitted by members through this service, and members are solely responsible for civil and criminal actions arising from their respective postings.
13. Compensation for Damages: In relation to the use of free services, the Jungto International does not take any responsibility for compensation for any damages incurred by members unless there is intentional or gross negligence.
14. Indemnification
- In the event that the Jungto International suspends the service due to natural disasters, emergencies, or other unavoidable circumstances, members shall be exempted from liability for problems caused by the service interruption.
- Jungto International is not responsible for any disruption to the service due to causes attributed to the member.
- Jungto International is not responsible for and does not guarantee the suitability, accuracy, timeliness, or reliability of any information, products, services, software, graphics, audio, and video provided through the service.
- Jungto International is not responsible for and does not guarantee the suitability, accuracy, timeliness, or reliability of the content posted by the members.
- When a member wishes to make a decision regarding legal, medical, or other financial matters based on the information obtained through the services provided by the Jungto International or the postings published by the other members, we recommend that the member consult with an expert in advance.
15. Dispute Resolution: United States law will govern the interpretation and application of these Terms and the resolution of any dispute relating to these Terms. The parties (a) hereby irrevocably and unconditionally submit to the jurisdiction of the state courts of Maryland and to the jurisdiction of the United States District Court for the District of Maryland for the purpose of any suit, action or other proceeding arising out of or based upon this Agreement, (b) agree not to commence any suit, action or other proceeding arising out of or based upon this Agreement except in the state courts of Maryland or the United States District Court for the District of Maryland, and (c) hereby waive, and agree not to assert, by way of motion, as a defense, or otherwise, in any such suit, action or proceeding, any claim that it is not subject personally to the jurisdiction of the above-named courts, that its property is exempt or immune from attachment or execution, that the suit, action or proceeding is brought in an inconvenient forum, that the venue of the suit, action or proceeding is improper or that this Agreement or the subject matter hereof may not be enforced in or by such court. In addition, the Parties agree to the waiver of a jury trial.
16. Change of Terms and Conditions: Jungto International may make changes to the terms and conditions without prior notice, and the change of terms and conditions will be announced on the website (www.forum.jungtosociety.org) so that members can check them directly. It is the members’ responsibility to review the Terms for updates and changes. If a member does not agree to the changed terms and conditions, they may cancel their membership. Continued use of the Jungto International service is regarded as consent to the change of terms and conditions. The changed terms and conditions will take effect as soon as they are announced.
